These Website Terms of Service (“Agreement”) are a binding contract between you (“User,” “you,” or “your”) and Your Hub, LLC (“Company,” “we,” “us,” or “our”), governing your access to and use of airlinecomplainthub.com (“Hub”) any other related websites operated by us or linked by us to third-parties, and any other applications, and related services (collectively, the “Platform” or “Services”).
By using or accessing the Platform, you agree to the terms of this Agreement and any other documents incorporated herein (e.g., our Privacy Policy, Additional Terms). If you do not agree, do not use the Platform.
1.1 What We Provide. We operate a Platform that offers certain services, content, tools, software, and features to allow you to generate and download airline complaint letters (the “Services”). Our Platform is web-based but may in the future include desktop, mobile, or web-based components, along with updates and documentation.
1.2 Parties. This Agreement is between you and Your Hub, LLC, including its parent, subsidiaries, affiliates, or related entities, collectively referred to as “Company.”
1.3 Binding Contract. When you use the Platform, you accept this Agreement. If you are using the Platform on behalf of a business or other entity, you represent that you have authority to bind that entity to this Agreement.
2.1 Age and Legal Capacity. You represent that you are at least 18 years old (or the legal age of majority in your jurisdiction) and have the legal capacity to agree to this Agreement. If you use the Services on behalf of a legal entity, you represent and warrant that you have authority to bind that entity.
2.2 Account Registration. To access certain features, you may need to register an account and provide certain information. You agree to provide true, current, and complete information, and to keep it updated.
2.3 Account Security. You are responsible for protecting the confidentiality of your account credentials. You will notify us immediately if you believe your account has been compromised. We are not liable for damages arising from your failure to protect your account.
3.1 Permitted Use. You may use the Platform for lawful, personal, or business purposes (as permitted), in accordance with this Agreement.
3.2 Beta and Trial Features. We may provide certain features or portions of the Platform in beta, early access, or trial form (“Trial Features”). Trial Features are provided “as is,” without warranties, and may be modified or removed at any time without notice.
3.3 Software License. If part of the Platform includes software you install or download, we grant you a limited, non-exclusive, non-transferable, revocable license to use that software for the period you are authorized, subject to the terms of this Agreement or any applicable ordering documents. All other rights are reserved by us.
4.1 User Content. You remain the owner of content you submit, upload, post, or otherwise make available through the Platform (“User Content”). By doing so, you grant us a worldwide, royalty-free license to use, reproduce, publish, distribute, modify, perform, or display that content as needed to provide, promote, and improve the Services.
4.2. Hub Content. You remain the owner of all airline complaint letters generated for you by the Hub. You grant us a worldwide, royalty-free license to use, reproduce, publish, distribute, modify, perform, or display that content, anonymized as needed, to provide, promote, and improve the Services.
4.3 Company Content & IP Rights. All content, materials, software, and intellectual property that are part of or used in the Platform (excluding User Content and Hub Content) are owned by or licensed to us. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission.
You agree to pay all fees and taxes associated with your account or subscriptions.
We may change fees or pricing without advance notice.
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your personal information. By using the Platform, you agree to our Privacy Policy.
Your use of the Platform is also governed by our ADA Accessibility Policy, which describes our efforts in complying with the requirements of the applicable ADA laws. By using the Platform, you agree to our ADA Accessibility Policy.
The Platform is provided “as is” and “as available,” with no warranties of any kind except as explicitly stated in this Agreement. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not guarantee that the Platform is error-free, secure, or uninterrupted.
TO THE FULLEST EXTENT PERMITTED BY DELAWARE LAW, COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.
COMPANY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain limitations of damages or liability; in such cases, those limitations may not apply.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your breach of this Agreement, your misuse of the Platform, or your violation of law.
We may suspend or terminate your access to the Platform at any time, for any reason, including breach of this Agreement or inactivity.
Upon termination, you must stop using the Platform. Your obligations under certain sections (e.g., IP rights, disclaimers, limitations, indemnification) survive termination.
This Agreement is governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.
Any dispute arising from or related to this Agreement shall be resolved by binding arbitration in Wilmington, Delaware, under JAMS Commercial Rules.
You and the Company waive any rights to a jury trial and/or to participate in class or representative actions, to the extent legally permitted.
We may modify this Agreement from time to time. If changes are material, we will notify you (e.g. via email or prominent notice on the Platform).
Your continued use after changes constitutes acceptance. If you do not agree with changes, you should stop using the Platform.
You represent that you are not located in, under the control of, or a national or resident of any country subject to embargoes or sanctions of the United States.
You agree not to use, export, re-export, transmit, or disclose the Platform, software, or any technical data, in violation of any U.S. or other applicable export laws or regulations.
Assignment. You may not assign your rights or obligations under this Agreement without our prior written consent. We may assign this Agreement or any rights under it at our discretion.
Severability. If any provision is held invalid, the rest of the Agreement remains in force.
Waiver. Our failure to enforce any right is not a waiver of that right.
Notices. Notices under this Agreement will be sent to your registered email or posted on the Platform, unless otherwise specified.
Entire Agreement. This Agreement, along with applicable policies, constitutes the entire agreement between you and the Company regarding the Platform.
